Terms of Service

Welcome to Elevate GLP. These Terms of Service ("Terms") form a binding agreement between you and Elevate GLP, LLC ("Elevate GLP," "we," "us," or "our") and govern your access to and use of www.elevateglp.com (the "Site") and any products, content, or services offered by us (collectively, the "Services").

Please read these Terms carefully. They include a binding arbitration agreement and class-action waiver (Section 14) that affect your legal rights. By using the Services or purchasing our products, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and able to form a legally binding contract to use the Services or purchase our products.

2. Health & Safety Disclaimer

Elevate GLP sells dietary supplements. Our products and content are for general wellness and informational purposes only and are not intended to diagnose, treat, cure, or prevent any disease. These statements have not been evaluated by the U.S. Food and Drug Administration.

The Services are not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before starting, changing, or discontinuing any supplement, medication (including GLP-1 medications), or treatment plan, especially if you are pregnant, nursing, have a medical condition, or take prescription drugs.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

4. Orders, Pricing & Payment

  • All orders are offers to purchase subject to our acceptance. We may decline or cancel any order at our discretion, including for suspected fraud, pricing errors, or product unavailability.
  • Prices are shown in U.S. dollars and may change without notice. Applicable taxes and shipping are added at checkout.
  • You authorize us (and our payment processors) to charge your payment method for the total order amount, including taxes and shipping.
  • Pricing or typographical errors do not bind us. If a product is listed at an incorrect price, we may cancel orders placed at that price.

5. Subscriptions & Auto-Renewal

If you enroll in a subscription, you authorize recurring charges to your payment method at the cadence and price disclosed at signup, until you cancel. You may cancel anytime through your account or by contacting info@elevateglp.com before the next billing date. We will send renewal reminders where required by law (including California's Automatic Renewal Law and similar state statutes).

6. Shipping, Risk of Loss & Returns

  • Shipping times are estimates, not guarantees. Title and risk of loss pass to you upon our delivery to the carrier.
  • We offer a 30-day satisfaction guarantee on eligible products. Contact info@elevateglp.com within 30 days of delivery to request a return.
  • Opened products may be returned under our guarantee but must be returned in original packaging where possible. Some items (e.g., promotional or final-sale items) may be non-returnable.

7. Promotions, Discounts & Codes

Promotional codes are limited to the terms disclosed at issuance, may be modified or canceled at any time, are non-transferable, and have no cash value.

8. User Content & Reviews

You may submit reviews, comments, or other content ("User Content"). You retain ownership but grant Elevate GLP a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to use, reproduce, modify, publish, and display User Content in connection with the Services and our marketing. You represent that your User Content is accurate, your own, and does not violate any third-party rights or law. We may remove User Content at our discretion.

9. Acceptable Use

You agree not to:

  • Violate any law or third-party rights;
  • Reverse engineer, scrape, or interfere with the Site or its security;
  • Upload viruses, malware, or content that is unlawful, defamatory, harassing, or infringing;
  • Misrepresent yourself or use the Services for fraudulent or commercial purposes without our written consent.

10. Intellectual Property

The Services, including all text, graphics, logos, product packaging, formulations, and software, are owned by Elevate GLP or its licensors and protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the Site for personal, non-commercial purposes. All other rights are reserved.

11. Third-Party Links & Services

The Site may link to third-party sites or services that we do not control. We are not responsible for their content, products, or practices.

12. Disclaimers

THE SERVICES AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY PRODUCT WILL ACHIEVE ANY PARTICULAR RESULT. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELEVATE GLP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR A PRODUCT WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $100. Nothing in these Terms limits liability that cannot lawfully be limited.

14. Dispute Resolution; Arbitration; Class Waiver

Please read this Section carefully. You and Elevate GLP agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or our products ("Disputes") will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual action in small-claims court.

The arbitration will take place in the U.S. county where you reside or, by agreement, by video conference. The arbitrator's decision is binding and may be entered as a judgment in any court of competent jurisdiction. The Federal Arbitration Act governs this Section.

Class-action waiver: You and Elevate GLP agree to bring Disputes only in our individual capacities and not as a plaintiff or class member in any class, collective, consolidated, or representative action. The arbitrator may award relief only on an individual basis. If this waiver is found unenforceable, the unenforceable portion will be severed and the remainder of this Section will continue to apply.

30-day opt-out: You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing info@elevateglp.com with your name, address, and a clear statement that you opt out.

15. Governing Law & Venue

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws principles. Subject to Section 14, any action not subject to arbitration must be brought exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction there.

16. Indemnification

You agree to indemnify and hold harmless Elevate GLP and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Services, your User Content, or your violation of these Terms or applicable law.

17. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for any reason. Sections that by their nature should survive (including Sections 8, 10, 12–16, and 18) will survive termination.

18. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date will reflect the most recent version. Material changes will be communicated by reasonable means. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.

19. Miscellaneous

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Elevate GLP regarding the Services. If any provision is held unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent; we may assign freely.
